In business, there are two people you always need to take care of, your attorney and your bail bondsman! Having a bail bondsman is like having insurance. You hope you never have to call but want to make sure they answer when you do!
TYPES OF BAIL…
Cash Bonds: if the bail is paid to the court in cash a cash bond will be issued. Anyone can post cash bail on behalf of the defendant. Bail money will be returned at the end of the case unless the defendant fails to show up for court.
Own Recognizance: a written promise signed by the defendant promising that they will show up for future court appearances and not engage in illegal activity while out on an OR. Only a judge or sheriff can issue these.
Surety bail: is when a third person agrees to be liable for the amount of the bail. They usu- ally do this by going to a bail bondsman and paying a fee equal to 12% of the bail (regulated by the state). They may also be required to sign a lien against their property to guarantee the amount of the bail. If the defendant goes to all his court appearances, then the bail bond is relinquished and you only lose the 12% you paid. If the defendant fails to appear in court, then you must cough up the full amount of the bail.
Bailey does a lot of work for insurance companies and other bail bondsmen. He works closely with local police, US Marshals and occasionally, the FBI. When on a recovery mis- sion (someone didn’t show up for court), he has to wear a badge and shirt to identify him- self as well as carry a gun and often wears a vest for protection. Should he not recover the subject w/in 180 days, he is out the bail money. He’ll uses any legal means necessary to track and find someone and has a high success rate to insure he isn’t out those funds. He’s also started a general agency to train other bail bondsmen. Basically, his agency acts as the new bondsman’s insurance/middle man.
Aside from the customary Bail Bonds work, he assist with warrants and background checks. Over the years, he’s learned that the business he is in is a good one, it done right. That’s what he’s hoping to pass along to others getting into the field.
